Sözleşmenin Konusu
2.1 İşbu Sözleşme, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ile 27 Kasım 2014 tarihli ve 29188 sayılı Resmî Gazete’de yayımlanan Mesafeli Sözleşmeler Yönetmeliği hükümlerine uygun olarak düzenlenmiştir.
2.2 İşbu Sözleşme’nin konusu; ALICI’nın, SATICI’ya ait www.trio-gold.com internet sitesi üzerinden elektronik ortamda sipariş verdiği, Ön Bilgilendirme Formu ve işbu Sözleşme’de nitelikleri belirtilen ürünün satışı ve teslimi ile Taraflar’ın hak ve yükümlülüklerinin belirlenmesidir.

ALICI tarafından SATICI’dan elektronik ortamda sipariş edilen ürünün;

GENEL HÜKÜMLER
4.1 İşbu Sözleşme, ALICI tarafından elektronik ortamda onaylandığı tarihte yürürlüğe girer.
Ürün bedelinin ödenmemesi veya banka kayıtlarında iptal edilmesi halinde, SATICI’nın teslim yükümlülüğü sona erer.
4.2 ALICI; ürünün temel nitelikleri, satış fiyatı, ödeme şekli, teslimat koşulları ve cayma hakkına ilişkin bilgileri içeren Ön Bilgilendirme Formu’nu okuyup anladığını ve elektronik ortamda onayladığını kabul eder.
4.3 ALICI, ürünü teslim almadan önce ambalajı kontrol etmekle yükümlüdür. Hasarlı veya ayıplı ürünleri teslim almayacaktır.
4.4 TRIO GOLD İNTERNET SİTESİ KULLANIM VE ÜYELİK SÖZLEŞMESİ, işbu Sözleşme’nin ayrılmaz parçasıdır.
4.5 Ürün, ALICI dışında bir kişi veya kuruluşa teslim edilecekse, teslimi kabul etmemesinden SATICI sorumlu değildir.
4.6 Gönderiler, sigortalı şekilde SATICI’nın anlaşmalı olduğu kargo firması aracılığıyla teslim edilir. ALICI’nın adreste bulunmaması halinde SATICI edimini yerine getirmiş sayılır.
4.7 Teslim alınmayan veya iade edilen ürünlere ilişkin masraflar ALICI’ya aittir.
4.8 Kredi kartının hukuka aykırı kullanımı nedeniyle banka tarafından bedelin SATICI’ya ödenmemesi halinde, ALICI ürünü 3 gün içinde SATICI’ya iade etmekle yükümlüdür.
4.9 Taksitli satışlara ilişkin faiz ve temerrüt şartları banka ile ALICI arasındaki sözleşmeye tabidir.
4.10 Cayma veya iade durumlarında kredi kartına iade, bankaların prosedürleri doğrultusunda yapılır.
4.11 Vergi Usul Kanunu gereği, iade işlemi için faturanın ilgili bölümü doldurulup imzalanarak ürünle birlikte gönderilmelidir.
4.12 Teslimin imkânsızlaşması halinde, SATICI 3 gün içinde ALICI’yı bilgilendirir ve 14 gün içinde bedeli iade eder.
CAYMA HAKKI
5.1 ALICI, ürünü teslim aldığı tarihten itibaren 14 gün içinde gerekçe göstermeksizin cayma hakkını kullanabilir.
5.2 Cayma bildirimi, tg@trio-gold.com adresine e-posta yoluyla yapılır.
SATICI’nın belirttiği taşıyıcı ile yapılan iadelerde masraflar SATICI’ya aittir.
5.3 Aşağıdaki hallerde cayma hakkı kullanılamaz:
- i) Fiyatı finansal piyasalara bağlı ürünler
ii) ALICI’ya özel üretilen, kişiselleştirilmiş veya sipariş üzerine hazırlanan ürünler
iii) Elektronik ortamda anında ifa edilen hizmetler ve dijital ürünler
iv) Mevzuat gereği mesafeli satış kapsamı dışında kalan ürünler
Üründe kullanım, çizik, bozulma olması halinde cayma hakkı kullanılamaz.
MÜCBİR SEBEPLER
6.1 Doğal afetler, savaş, terör, salgın, kamu otoritelerinin kararları, grev, tedarik zinciri aksaklıkları gibi tarafların kontrolü dışında gelişen haller mücbir sebep sayılır.
6.2 Mücbir sebep 30 gün sürerse, taraflardan her biri sözleşmeyi tek taraflı feshedebilir.
GİZLİLİK
ALICI’ya ait kişisel veriler, Trio Gold Kişisel Verilerin Korunması ve Aydınlatma Metni kapsamında işlenmektedir.
YETKİLİ MAHKEME
Uyuşmazlıklarda, mevzuat gereği Tüketici Hakem Heyetleri veya Tüketici Mahkemeleri yetkilidir.
Tüketici Mahkemesi bulunmayan yerlerde Asliye Hukuk Mahkemeleri yetkilidir.
İşbu Sözleşme elektronik ortamda düzenlenmiş, okunmuş ve kabul edilmiştir.

SUBJECT OF THE AGREEMENT
2.1 This Agreement has been prepared in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, published in the Official Gazette dated 27 November 2014 and numbered 29188.
2.2 The subject of this Agreement is to determine the rights and obligations of the Parties regarding the sale and delivery of the product(s) ordered electronically by the BUYER through the website www.trio-gold.com, the characteristics of which are specified in the Preliminary Information Form and this Agreement.
PRODUCT DETAILS, PRICE, AND PAYMENT METHOD
The product ordered electronically by the BUYER from the SELLER has the following characteristics:

As products are handcrafted, a weight variance of ±5% may occur for made-to-order items. The final weight and value shall be stated on the invoice and, where applicable, on the certificate.

GENERAL PROVISIONS
4.1 This Agreement enters into force on the date it is electronically approved by the BUYER.
If the product price is not paid or the payment is canceled in bank records for any reason, the SELLER shall be released from the obligation to deliver the product.
4.2 The BUYER declares that they have read and understood the Preliminary Information Form and all information regarding the essential characteristics of the product, price, payment method, delivery conditions, and right of withdrawal, and that they have given electronic approval accordingly.
4.3 Before accepting delivery, the BUYER shall inspect the package and shall not accept damaged, torn, or defective products from the carrier.
4.4 The TRIO GOLD WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT constitutes an integral part of this Agreement.
4.5 If the product is to be delivered to a person or entity other than the BUYER, the SELLER shall not be liable if such person or entity refuses delivery.
4.6 Shipments shall be delivered via the SELLER’s contracted and insured carrier. If the BUYER is not present at the delivery address, the SELLER shall be deemed to have fully fulfilled its obligation.
4.7 Any costs arising from delayed acceptance, failure to accept delivery, or return of the shipment shall be borne by the BUYER.
4.8 If the payment is not transferred to the SELLER due to unlawful or unauthorized use of the BUYER’s credit card not attributable to the SELLER, the BUYER shall return the delivered product to the SELLER within three (3) days.
4.9 For installment purchases made via credit card, interest rates and default interest conditions are determined exclusively by the bank and are not the responsibility of the SELLER.
4.10 In cases of withdrawal or refund, credit card refunds shall be processed in accordance with the procedures of the relevant bank.
4.11 Pursuant to tax regulations, refund procedures require the invoice to be duly completed, signed, and returned together with the product.
4.12 If delivery of the product becomes impossible, the SELLER shall notify the BUYER within three (3) days and refund the amount paid within fourteen (14) days at the latest.
RIGHT OF WITHDRAWAL
5.1 The BUYER has the right to withdraw from the contract within fourteen (14) days from the date of delivery without providing any justification.
5.2 Withdrawal notification shall be made via email to tg@trio-gold.com.
Returns made using the carrier designated by the SELLER shall be free of charge for the BUYER.
5.3 The right of withdrawal may not be exercised in the following cases:
- i) Products whose price fluctuates depending on financial market conditions beyond the SELLER’s control,
ii) Products made in accordance with the BUYER’s personal requests or personalized, made-to-order, or custom-produced items,
iii) Services performed instantly in electronic form and digital content delivered immediately,
iv) Products excluded from the scope of distance sales under applicable legislation.
For avoidance of doubt, if the product shows signs of use, damage, scratches, deformation, or deterioration beyond ordinary handling, the right of withdrawal shall not apply.
FORCE MAJEURE
6.1 Events such as natural disasters, earthquakes, fires, floods, wars, terrorism, epidemics, pandemics, governmental actions, strikes, lockouts, supply chain disruptions, or major failures in production or communication facilities beyond the control of the Parties shall be considered force majeure.
6.2 If the force majeure event continues for more than thirty (30) days, either Party shall have the right to terminate the Agreement unilaterally.
PRIVACY
The BUYER’s personal data shall be processed in accordance with the Trio Gold Personal Data Protection and Privacy Notice.
COMPETENT COURT
In disputes arising from this Agreement, Consumer Arbitration Committees shall be competent up to the monetary limits announced annually by the Ministry of Trade.
For disputes exceeding such limits, Consumer Courts shall have jurisdiction.
Where no Consumer Court exists, Civil Courts of First Instance shall be competent.
This Agreement has been concluded electronically, read, and accepted by the Parties.
